Todd Mohn’s Wrap Up of the Oct 11 County Commissioner Meeting


The Commissioners October 11th meeting started at 4:30 pm with a closed session to Consult with Counsel.   The regular meeting was called to order at 5:30 pm


LEGISLATION (5:40 PM Hearing)


  1. Hearing County Ordinance No. 22-11                          

A BILL ENTITLED AN ACT CONCERNING Treatment Charges for Septage; FOR THE PURPOSE of revising the provisions regarding treatment charges for sewage septage; providing that such charges will be established under the Queen Anne’s County Sewer System Rate Schedule and may be amended from time to time by Resolution of the County Commissioners of Queen Anne’s County; and generally revising and updating the provisions on septage treatment charges in Queen Anne’s County; BY AMENDING Section 24-120 of the Code of Public Local Laws of Queen Anne’s County, Maryland;    Record will remain open for two weeks

  1. Acquisition of State Owned Right-of-Way (ROW) 

The County was sent correspondence from State Highway Administration (SHA), Office of Real Estate, regarding their intent to surplus a portion of the State Right-of-Way. The State gives the County ‘Right of First Refusal’ before advertising for sale on the open market. The County has a Sewer Force Main running through this ROW. With the Sewer Force Main crossing this ROW and the ROW being adjacent to the Kent Island High School, County Staff is recommending purchasing this portion of the ROW (Parcel I) in order to preserve the Sewer Force Main access/integrity and the Board of Education Buffer. Parcel 1 is the land County staff is recommending purchasing in the amount of $18,500 (eighteen thousand five hundred dollars). An appraisal for the ROW land (Parcel 1) is attached.  APPROVED 5-0


  1. 2022 Annual MDOT Tour – FY2023-2028 Consolidated Transportation Plan 

Secretary Ports is scheduled to hold the MDOT annual Tour Meeting to discuss the
 Draft Consolidated Transportation Plan on Tuesday October 
25, 2022 at 3:00 pm. Attached is
 information that will be discussed during the meeting. If there are additional topics or
 improvements, you wish to discuss please let me know so MDOT can be prepared.


1) Continue and expedite the process to add capacity crossing the Chesapeake Bay to
 reduce congestion in the Bay Bridge corridor (NEPA Tier 2)
 2) Construct improvements on the MD 18 corridor 
from Castle Marina Road to the
 Kent Narrows
 3) Construct the US 50 & 213 interchange
 4) Construct at-grade intersection improvements on the US 301 corridor
 5) Provide repair and repaving on US 301 Southbound
 6) Continued support of local transit efforts
7) Continued support for bicycle and pedestrian improvements (Overpass to connect Cross Island Trail and Cross County Connector Trail)
 8) Support regional coordination for transportation projects   


  1. Slippery Hill Phases 2 and 3 Public Works Agreement

This is the Public Works Agreement for Green Street Housing’s Slippery Hill Phases 2 & 3.

Phases 2 and 3 consist of an additional 74 apartments (44 1-bed apartments, 9 2-bed apartments, and 21 3-bed) and 46 elderly apartments. The original allocation grant of 22,550-gpd was insufficient for this total build-out so on January 8, 2019 the Sanitary Commission granted the balance of allocation necessary. This is the PWA to provide the additional allocation and terms for payment. The Agreement’s format has been approved by the County Attorney.  APPROVED 5-0

  1. Growth Allocation Petition (Extension Request) – Nashville Properties, LLC

A growth allocation petition has been filed for Nashville Properties, LLC. requesting growth allocation to reclassify 2.811 acres of Limited Developed Area to Intensely Developed Area. This request includes existing Parcels 351, 352, and 287 located on Tax Map 57 on Pinev Creek Road and Nash Court. These parcels will he absorbed into Parcel 351 by administrative subdivision. The applicant is proposing a 156,000 square-foot, 4-story, self-storage facility with interior access only and associated parking. Currently, the County has approximately 461 acres of Growth Allocation remaining. The applicant is seeking more time (a 60-day review extension) to address the Planning Commissions technical comments which will ensure that the growth allocation petition and affiliated concept plan are consistent. APPROVED 5-0


  1. Funding Request – Alumni of South County and Kennard Elementary Schools                                                                                   

The Alumni of South County and Kennard Elementary Schools will be hosting a cultural evening on November 5, 2022 at the Kent Island Fire Department. The evening will consist of honoring the teachers that taught at the two schools and also the recognition of the 6th graders in the last segregated classes in Queen Anne’s County. The South County and Kennard Elementary Schools Committee is respectfully requesting $3,000 to assist in the funding for this event. APPROVED 5-0 FOR $4,000


4.   Budget Amendment CC-22:  Sheriff’s Office PACT Grant       

The FY2023 Police Accountability, Community and Transparency (PACT) grant award is $312,470 based on a letter received September 2022. This is a new grant and currently no funds are budgeted. This amendment establishes budget authority of $31,200 for a part-time contractual Victims’ Rights Advocate, $132,600 for training and contractual services, and $148,670 for equipment. No additional County funds are requested. APPROVED 5-0


  1. Budget Amendment CC-23 Railroad Ave Mold Mitigation    

This amendment for $150,000 will establish budget authority in the Railroad Ave Mold Mitigation project for emergency mold mitigation.  It is necessary to change the ductwork and replace an HVAC unit. In addition, the ductwork in the “newer/east side” of the building will need to be cleaned. APPROVED 5-0


6.    Budget Amendment #CC-24 – SKI Community Mains Phase 4      

This amendment establishes budget authority for the SKI Community Mains Phase 4. The expenditures of this project are to be paid up front by the Sanitary District and then repaid by state loan. The entire project is expected to cost approximately $12,000,000 however, this amendment will cover the near-term expenses up to $100,000. No County (General) funds are requested. APPROVED 5-0


Desk Item #1 -   Program to Encourage Active & Rewarding LiveS (PEARLS) -  This is a sole source contract to provide one-on-one telephonic services designed to treat individuals with  depression, physical impairments and/or social isolation. In addition, this covers staff enrollment for training into the chronic disease self-management program (for up to 12 members of the health department staff). Overall this program will handle up to 60 clients and the total cost of $48,000 is funded through a grant. No county funds are needed.  This is a new and unique program for our region.  APPROVED 5-0
