Declaration

A Declaration is a legal document used to combine 2 or more lots into 1 or fewer lots without a new plat.

This subdivision technique requires that all existing lots must have been established on a single plat and recorded in the land records of the County prior to April 9, 1987. All resulting lots are defined solely by reference to metes, bounds, courses, and distances set forth on the single plat.

Process

Typically, a Declaration is reviewed internally by staff, primarily the Attorney to the Planning Department, who approves and signs the documents for legal sufficiency.
